CompuShow License Agreement

This agreement is between the distributor of CompuShow, Man's Best Friend of Oak Forest, IL, hereinafter known as MBFS, and the below named club/user, hereinafter known as the Club. CompuShow is a computer program written, and Copyrighted (C) 1984-1999 by Man's Best Friend Software. All Rights Are Reserved. CompuShow is also a trademark of MBFS. The program user manual is also Copyrighted by MBFS and ONLY the license agreement pages may be copied.

The Club May: (1) ONLY use CompuShow for shows that are specifically licensed by The Cat Fancier's Association, Inc. and produced by the Club under the Club's name and charter; (2) Use CompuShow on one or more computers, provided at least one manual has been purchased for each computer used; (3) Transfer the license to use CompuShow to another club, IF: the license has NOT been transferred in the previous 12 months; and the Club transfers all copies of CompuShow, whether in printed or machine readable form, to the other club, and destroys any copies not transferred, this includes portions of CompuShow merged into any other programs; and the other club executes a copy of this agreement with MBFS, and pays MBFS a $50.00 transfer fee.

The Club MUST INCLUDE, in every show catalog, for which show CompuShow was used in part or in whole, either a copy of the CompuShow Breed Summary as printed, or in a legible form and in a prominent place, the following statement: "This show and catalog were produced with the aid of CompuShow, Copyright (C) 1984-2000 by Man's Best Friend Software."

The Club MAY NOT use, copy, modify, or transfer CompuShow, or any copy or modification of CompuShow in whole or in part, except as expressly provided for in this license agreement. If the Club sub-licenses, rents, leases, or allows another party to use CompuShow in any way, and/or if the Club transfers possession of any copy, modification or merged portion of CompuShow to another party, without written permission from MBFS, the Club's license to use CompuShow will be terminated and legal actions may be taken (see below).

You are hereby advised that CompuShow is protected by both United States Copyright Law and International Treaty Provisions, and that if you use and/or allow someone else to use CompuShow, contrary to the provisions stated herein, you may be subject to criminal and/or civil prosecution for theft and/or copyright violations. Vilolations of U.S. Copyright Laws are considered FELONIES and convictions of same carry stiff penalties and jail terms.

If ANY copies of the data files produced by the Club using CompuShow, or portions of same, are sold or transferred to ANY third party, in a machine readable format, then the Club MUST insure that a free copy of same is mailed to MBFS within thirty (30) days of such sale or transfer. (Note: CFA is currently cooperating with clubs to comply with this requirement by forwarding to MBFS disks sent to them by clubs. However, it is the Club's responsibility to request that CFA forward the disks to MBFS, and failure of CFA to do so shall not abrogate this requirement.) Data files, or portions of same, received by the Club from MBFS, MAY NOT be transferred, in a machine readable format, to ANY third party, other than The Cat Fanciers Association, Inc., without permission in writing from MBFS.

CompuShow is provided "AS IS" without warranty of any kind, either expressed or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the use and performance of CompuShow is with the Club. Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. In no event will MBFS be liable for any damages, including any lost profits or other incidental or consequential damages arising out of the use or inability to use CompuShow, even if MBFS has been advised of the possibility of such damages, or for any claim by any other party. MBFS's entire liability and the Club's exclusive remedy shall be the replacement of defective diskettes. MBFS does warrant the diskette(s) on which CompuShow is furnished, to be free from defects in materials and workmanship under normal use for a period of ninety (90) days from the date of delivery. All parties to this agreement acknowledge that this document is the complete and exclusive statement of this agreement.

Multi-Show and Professional use licenses are perpetual and may be used for mutiple shows. One-Show licenses may ONLY be used for one show on the date for which they were purchased. For each One-Show license purchased MBFS will issue a non-transferable $50.00 credit, that the Club may later use when purchasing a Multi-Show or Professional use license.
